Welcome to Power4Change.

These Terms & Conditions govern your use of the Power4Change website, including donations, fundraising, merchandise purchases, volunteer applications and other interactions with Power4Change Ltd. ("Power4Change", "we", "us" or "our").

By using our website or purchasing, donating or submitting information through it, you agree to these Terms & Conditions.

1.About Power4Change

Power4Change Ltd. is an Australian registered charity with Deductible Gift Recipient (DGR) status.

We exist to deliver practical, direct support to vulnerable and disaster-affected communities through charitable projects and initiatives.

Our website provides information about our work and allows supporters to donate, purchase merchandise, participate in fundraising, volunteer, partner with us and support our projects.

2.Using our website

You agree to use our website lawfully and responsibly.

You must not:

  • use the website for fraudulent, unlawful or malicious purposes;
  • attempt to interfere with the security or operation of the website;
  • introduce viruses, malicious code or other harmful material;
  • attempt to gain unauthorised access to our systems or accounts;
  • impersonate Power4Change or falsely claim to represent us;
  • reproduce or commercially exploit our content without permission; or
  • use our name, branding or fundraising activities in a misleading or unauthorised way.

We may restrict or terminate access to our website where we reasonably believe these Terms have been breached.

3.Donations

Donations made directly to Power4Change are used to support our charitable purposes, projects and operations.

Where a donation is made to a specific campaign or project, we will endeavour to apply those funds toward that purpose.

However, circumstances affecting charitable projects can change. Where it becomes impractical, impossible or no longer appropriate to use funds exactly as originally intended, Power4Change may apply those funds to a related charitable purpose or another area of greatest need consistent with our charitable objectives and applicable law.

Online payments may be processed through third-party payment providers such as Stripe. Peer-to-peer fundraising may also be facilitated through Zeffy.

Tax deductibility

Power4Change Ltd. has Deductible Gift Recipient status.

Eligible gifts of $2 or more may be tax deductible in Australia, subject to Australian taxation law and the individual circumstances of the donor.

A payment made in exchange for goods or another material benefit, including the purchase of merchandise, is generally not a donation merely because the proceeds support Power4Change.

The ATO distinguishes genuine gifts from payments where the supporter receives a material benefit in return.

You should seek your own tax advice if you are uncertain about whether a particular payment is deductible.

4.Donation refunds

Donations are generally final.

However, we understand that mistakes can happen. If you believe a donation was made accidentally, duplicated, made for an incorrect amount or involved an unauthorised transaction, please contact us as soon as possible at info@power4change.org.

Refund requests will be considered individually, taking into account the circumstances and whether the funds have already been committed or applied to a charitable project.

Nothing in this section limits any rights you may have under applicable law.

5.Peer-to-peer fundraising

Power4Change may allow individuals, schools, community groups, businesses and other supporters to create fundraising campaigns in support of our work.

Peer-to-peer fundraising may be facilitated through third-party platforms such as Zeffy and may also be subject to that platform's terms and privacy practices.

If you create a fundraiser for Power4Change, you agree to:

  • represent your relationship with Power4Change accurately;
  • not claim to be an employee, agent or official representative of Power4Change unless authorised;
  • conduct your fundraising lawfully, safely and responsibly;
  • not make misleading claims about Power4Change, its projects or how funds will be used;
  • obtain any permits, approvals, licences or insurance required for your activity; and
  • not use Power4Change's name or branding in a way that could reasonably damage the charity's reputation.

Creating a fundraiser does not create an employment, agency, partnership or joint venture relationship with Power4Change.

We reserve the right to ask a fundraiser to stop using our name or branding where we reasonably believe an activity is unlawful, unsafe, misleading, inappropriate or inconsistent with our charitable purposes or values.

6.Merchandise

Power4Change may sell merchandise through our website to raise funds and support our work.

Product photographs and descriptions are provided as accurately as reasonably possible. However, colours and appearance may vary slightly depending on screens, production batches and other factors.

Prices are displayed in the currency shown at checkout.

Payment for merchandise is processed through Stripe or another payment provider displayed at checkout.

An order is not considered accepted until payment has been successfully processed and the order has been confirmed.

7.Shipping

Merchandise orders are packed and shipped by Power4Change.

We will endeavour to process and dispatch orders within the timeframes communicated on our website or at checkout.

Delivery estimates are estimates only. Delivery times may be affected by postal services, couriers, customs, weather, remote locations and circumstances outside our reasonable control.

Customers are responsible for providing complete and accurate delivery information.

If an order is returned to us because incorrect or incomplete delivery information was provided, additional postage costs may apply before the order is resent.

8.Returns, refunds and faulty products

Change of mind

Power4Change does not offer returns, exchanges or refunds simply because you change your mind, order the wrong size, no longer want an item or decide you do not like it.

Please check product information and sizing carefully before placing your order.

Faulty, damaged or incorrect products

Our change-of-mind policy does not affect your rights under the Australian Consumer Law.

Goods sold to consumers come with consumer guarantees that cannot be excluded by these Terms.

If an item is faulty, damaged, significantly different from its description or otherwise fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.

The ACCC confirms that businesses cannot use a "no refunds" policy to remove these statutory rights.

If there is a problem with your order, contact info@power4change.org with your order details and, where relevant, photographs of the issue.

9.Volunteers

Submitting a volunteer application or expression of interest does not guarantee a volunteer position or participation in a Power4Change project.

Volunteer opportunities may depend on project requirements, location, experience, skills, safety considerations and other circumstances.

Some projects, particularly international or field-based activities, may require additional agreements, qualifications, background checks, health or safety requirements, insurance or other documentation.

Any such requirements will be communicated separately where applicable.

10.Partners and supporters

Submitting a partnership, sponsorship or support enquiry does not create a binding relationship between you and Power4Change.

Any formal partnership, sponsorship, supply arrangement or other collaboration may be subject to a separate written agreement.

Power4Change will not use a business or organisation's logo in a way that implies an agreed partnership without appropriate permission.

11.Photographs, stories and project content

Power4Change may publish photographs, videos, stories and other material documenting our projects and activities where we have the appropriate permission or lawful basis to do so.

You may not reproduce, modify, distribute or commercially use Power4Change's photographs, videos, stories or other original content without our permission, except where permitted by law.

12.Intellectual property

Unless otherwise stated, the Power4Change name, logos, branding, website design, written material, graphics, photographs, videos and other original content are owned by or licensed to Power4Change Ltd.

You may share links to our website and social media content for genuine non-commercial purposes.

You must not use Power4Change's name, logo or branding in a way that suggests endorsement, affiliation, sponsorship or authorisation where none exists.

13.Third-party websites and services

Our website may contain links to or integrations with third-party services, including Webflow, Stripe, Zeffy, Google and social media platforms.

Third-party services operate under their own terms, policies and practices.

While we take reasonable care when selecting services we use, Power4Change does not control third-party platforms and is not responsible for their independent operation, availability or content to the extent permitted by law.

14.Information on our website

We aim to keep information on our website accurate and up to date.

However, charitable projects can operate in changing environments, particularly in disaster-affected, remote or international communities. Project plans, timelines, budgets, locations, partners and activities may therefore change.

Information on our website is provided for general informational purposes and should not be relied upon as professional, legal, financial, medical or other specialist advice.

15.Limitation of liability

To the maximum extent permitted by law, Power4Change is not liable for loss arising solely from your reliance on general information published on our website or from circumstances outside our reasonable control.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded or limited, including rights under the Australian Consumer Law.

16.Privacy

Your privacy is important to us.

Our collection, use and handling of personal information is governed by our Privacy Policy, available on our website.

By interacting with our website, you acknowledge that personal information may be handled as described in that policy.

17.Changes to these Terms

We may update these Terms & Conditions from time to time to reflect changes to our website, activities, services or legal obligations.

The current version will be published on our website with the date it was last updated.

18.Governing law

These Terms & Conditions are governed by the laws of Australia and the applicable laws of the State or Territory in which Power4Change Ltd. is registered or principally operates.

Nothing in these Terms limits any rights available to consumers under applicable Australian law.
